It’s Hard to Spot the Distinction, But Knowing This Matters

A federal judge has decided to proceed with a lawsuit against McCormick & Co., a well-known spice manufacturer, despite the company’s objections. The lawsuit pertains to the quantity of ground pepper contained in McCormick’s tins.
Watkins Inc., a smaller competitor in the spice market, initiated the lawsuit last year, alleging that McCormick had decreased the amount of pepper in its tins by 25% while maintaining the same tin size. Previously, McCormick’s tins held approximately 8 ounces of ground pepper, but they now contain around 6 ounces.
Although the quantity has been reduced, the size of the tin has not changed. Watkins contends that this creates a misleading impression, suggesting that McCormick is offering more pepper per tin than is actually the case.
Both Watkins and McCormick offer similar products, yet their marketing strategies differ significantly. McCormick utilizes opaque containers that conceal the actual amount of product inside, whereas Watkins employs smaller containers that hold the same quantity as McCormick’s. This discrepancy is the basis for Watkins’ lawsuit against McCormick.
